A RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE TO ENTER INTO A NEGOTIATED PROCUREMENT FOR THE PURCHASE OF TWO (2) UNITS MOTORCYCLE AFTER TWO FAILURE OF PUBLIC BIDDINGS.

WHEREAS, the Bids and Awards Committee (BAC) of the Maribojoc LGU had conducted two public biddings for the purchase of two (2) units motorcycle and no prospective bidders applied for eligibility to bid for both bidding schedules;
WHEREAS, the BAC, through resolutions, respectively declared the two biddings a failure;
WHEREAS, Sec. 53 of Republic Act No. 9184 (Government Procurement Reform Act) allows the procuring entity to resort into Negotiated Procurement after two failed public biddings;
WHEREAS, the BAC has recommended to resort to a negotiated contract for the purchase of the two (2) units motorcycle;
WHEREFORE, BE IT RESOLVED, as it is hereby resolved to authorize the Local Chief Executive to enter into a Negotiated Mode of Procurement for the two (2) units motorcycle after two failure of public biddings;
RESOLVED FURTHER, that copies of this resolution be furnished to the office of the BAC, to the Commission on Audit for appropriate action.
