AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 07, SERIES OF 1964 TO AN ORDINANCE DECLARING CURFEW HOURS FROM 10:00 P.M. TO 4:00 A.M. FOR MINORS AND 12:00 P.M. TO 4:00 A.M. FOR ADULTS.

WHEREAS, the Local Government Code of 1991 empowers the Sangguniang Bayan to maintain peace and order by enacting measures to prevent and suppress lawlessness, disorder, riot and violence imposing penalties for such crimes;

WHEREAS, it is an inherent right of the state to maintain peace and order, protect the life, liberty and property and the promotion of the general welfare are essential for the enjoyment by all the constituents the blessings of democracy;

WHEREAS, the exercise of the police power is vested in the legislative body of the government as the body that decides what measures are necessary for the protection of social interests;

NOW, THEREFORE, premised on the following reasons, be it ordained by the Sangguniang Bayan, that:

SECTION: 1. The word minor refers to all individuals below 18 years old.

SECTION: 2. No minors are allowed to roam, to loiter in store, eateries, billiards hall
or any place of amusement during curfew hours.

SECTION: 3. No person shall conceal or assist in the concealment of any minor who
violates the provision of section 2.

SECTION: 4. The Municipal serene shall be sounded at 9:45 P.M. every night as
warning and prolong serene at 10:00 o’clock every night to signal the curfew hour.

SECTION: 5. For far barangay shall adopt any warning devices to signal the curfew
hours the same as in Section 4.

SECTION: 6. Minors who are asked to run an errand and witness the show, fiesta and
other town activities and people engaged in livelihood, such as fishermen, laborers and other emergency cases are exempted in this provision.

SECTION: 7. All sari-sari stores in the respective barangays shall be closed at 11:00
o’clock P.M. and shall be opened only at 4:00 A.M.

SECTION: 8. All gambling games, parlor or playing cards shall be closed at 11:00
o’clock P.M. except during the wake hours of family bereavement.

SECTION: 9. Persons who violate this ordinance shall be fined in the amount of two
hundred pesos (P200.00) or an imprisonment of not more than six months or both at the discretion of the court.

SECTION: 10. This ordinance shall take effect upon approval.
