“AN ORDINANCE PROVIDING RULES AND REGULATIONS IN THE MAINTENANCE OF CLEANLINESS IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, the objective of this program “Operation Hinlo” is to promote to the health of the citizenry and to make the environment “Clean and Green”;

WHEREAS, it is a prime duty of the state to oversee that cleanliness is maintained by the people living in the community and providing funds for the maintenance of cleanliness in public places;

NOW, THEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol, that:

Article I

PURPOSE AND SCOPE

SECTION: 1. This ordinance is enacted in order to support the program of LGU
“Operation Hinlo” and to maintain the cleanliness in the whole municipality particularly in every household and public places within the jurisdiction of Maribojoc, Bohol.

SECTION: 2. This ordinance shall include the maintenance of cleanliness in the
following:
a) Every household and its surroundings
b) Streets, sidewalks, canals alleys and plazas
c) Public market, schools, public buildings and parks
d) Rivers, Seashores, Beaches and Wharves
e) Private buildings and private school buildings
f) Public and private cemeteries
g) Bathing resort
h) And others not mentioned above

Article II

ZONING IN THE BARANGAYS

SECTION: 1. To ensure effective and efficient maintenance of cleanliness, every
barangay shall be divided into zones or puroks wherein the supervision shall be effective and efficient.

SECTION: 2. Every purok in the barangay shall consist of not less than 15 families
and not more than 20 families;

SECTION: 3. The Barangay Development Council shall draw and formulate plans for
effective zoning and to be approved by the Barangay Council of its barangay.

SECTION: 4. Every zone or purok shall be headed by a Purok Leader to be elected by
the people of a particular purok.

SECTION: 5. Every Purok Leader shall submit the list of Members of its purok and
this shall be submitted to the Municipal Development Council for monitoring purposes of their activities.

SECTION: 6. Every Purok in the barangay shall bear a name for monitoring and
identification purposes.

Article III

SCHEDULE OF CLEANING OF PUBLIC AND PRIVATE PLACES

SECTION: 1. The Purok Leader and the member of the purok shall conduct a
“pentekasi” twice a month in their respective areas of responsibilities and the date, and time shall be decided by the purok members.

SECTION: 2. The date and time of the “pentekasi” of every purok shall be submitted
to the Secretariat of the MDC for monitoring purposes;.

SECTION: 3. Town Kagawads in coordination with the Barangay Officials shall
monitor the activities of every purok and the SB Members are encouraged to visit the puroks whenever they are conducting a “pentekasi”.

SECTION: 4. All officials and employees of the National, Provincial and Municipal
agencies including DECS employees are required to render a periodic “pentekasi” to be determined by the Chief Executive thru a Memorandum at the public market, public plazas, streets and other places which need to be cleaned all the time.

SECTION: 5. All PO’s, NGO’s, Civic groups, religious organizations, students
group, private employees are enjoined to participate in the maintenance of cleanliness of the entire municipality in order to have a healthy environmental atmosphere of the community.

Article IV

CUSTODY OF DOMESTIC ANIMALS

SECTION: 1. Animals such as carabaos, cows, goats, pigs, dogs, cats and other
animals shall be kept by the owner within their homes or inside their perimeter fence of their respective areas.

SECTION: 2. No animals are allowed to roam around the streets, public places,
public buildings, church and chapels so that cleanliness in the community shall be maintained at all times;

SECTION: 3. Animals caught by a “Task Force” shall be impounded in the town’s
“Coral fence” and the owner shall be penalized per provisions of a separate ordinance on poundage fee.

SECTION: 4. Pasturing of animals in public plaza and along public highways are
strictly prohibited.

Article V

CLEANLINESS IN EVERY HOUSE AND ITS SURROUNDINGS

SECTION: 1. Every house owner shall maintain a clean house and clean
surroundings.

SECTION: 2. Every house shall have garbage can / trash can like plastic, container
cartoon, cellophane from the following garbages and to be thrown to compost pit, divided into:

a) Non-biodegradable waste – empty cans, plastic, containers, wrapper, broken glass, cellophane.

b) Biodegradable Waste – like the fruit peels, papers and can be used as feed materials for animals and fuel materials.

SECTION: 3. Every household shall be kept clean especially properties lining the
street from the line of the property to the middle of the street from one property to the other.

SECTION: 4. Every household shall have a good and blind drainage system around
his house for cleanliness purposes.

SECTION: 5. Every House near the parks, plazas and street adjacent to public
buildings shall be kept clean.

SECTION: 6. Every Household shall have Water Sealed toilet

SECTION: 7. Throwing of dead animals in any place of the barangay is strictly
prohibited.

SECTION: 8. It is unlawful of an individual to throw cigarette butts, banana stick,
cellophane, candy wrappers, fruit peels in any place of the Barangay including municipal streets.

SECTION: 9. It is unlawful for any person to urinate beside a parked vehicle and
other public places.

Article VI

FINAL PROVISIONS

SECTION: 1. Penal Provision

Any violation to the provisions of this ordinance shall be fined
in the amount of P500.00 or an imprisonment of ten (10) days or both at the discretion of the court.

SECTION: 2. Separability Clause.

Any provision, section or part of this ordinance be declared in
valid by any court of competent jurisdiction, such judgment shall not affect the remaining provisions, sections or pars which shall continue to be in full force and affect.

SECTION: 3. Repealing Clause.

All Municipal Ordinance, rules and regulations which are
inconsistent to the provisions of this ordinance are hereby repealed, modified or modified accordingly.

SECTION: 4. Effectivity.

This ordinance shall take effect after its approval and two
months information drive and Billboard be put-up on strategic area in the different barangays of the Municipality of Maribojoc, Bohol thru the SB Members and Barangay Officials of their respective barangays.
