AN ORDINANCE PROHIBITING THE BURNING OF RICE STRAW IN THE BARANGAYS WITHIN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, the Municipality of maribojoc has profound vision of making the constituents more responsive to Agro-Industrial Development and Countryside growth and progress;

WHEREAS, relative to the provision of Section 17 the Local Government Code of 1991, the Local Government shall endeavor to be self-reliant and shall continue exercising the powers and discharging the duties and functions currently vested upon them, hence agricultural support services which include technical know-how is the top priority functions of our Municipal Government;

WHEREAS, it disclosed that the best and cheapest substitute for the commercial fertilizer is the so called organic fertilizer which encompass among others decay manure and rice straw;

WHEREAS, after careful and expert analysis, it was uncovered that rice straw indeed said and conserve fertility to the soil and therefore very useful for mulching any kinds of plants. It is also the primary source for mushroom culture and this was proven under so many years of thorough experimentation, the fact it contains the highest nutrients among all kinds of organic fertilizer;

WHEREAS, rice straw is used for enriching the soil and hence this could be utilized as the cheapest source of fertilizer with the same production output in the long period compared to the costly commercial fertilizer. It was found out that two to three years continuous application or organic fertilizers then becomes a good replacement of the commercial fertilizer. In other words, two to three years after, there is no need anymore to use a commercial fertilizer;

NOW, THEREFORE, be it ordained by the Sanggunioang Bayan of Maribojoc, Bohol, in its session duly assembled, that:

Section 1- To burn the rice straw by any farmer, person or group of persons, manager, proprietor, corporation and other rice plantation owners within the Barangays in the Municipality of Maribojoc is deemed unlawful.

Section 2- Exemption: When the rice field of the farmer or farmers are severely affected by rice pest and diseases, the rice straw must be burned immediately after harvest.

Section 3- Penalty: Any farmer, person or group of persons, as enumerated in Section 1 of this ordinance, who violates the provision of this ordinance shall be fined in the following schedule:

1st Offense P 50.00
2nd Offense P 75.00
3rd Offense P100.00 plus two(2) days imprisonment or both at
the discretion of the court.

Section 4- Repealing clause: Any ordinance, rules and regulations order or portion thereof which is contrary to or inconsistent with this ordinance is hereby repealed, amended or modified accordingly.

Section 5- Effectivity: This ordinance shall take effect upon approval.
