“AN ORDINANCE REQUESTING ALL BUSINESS ESTABLISHMENTS TO REGISTER AND SECURE A BUSINESS / LICENSE REGISTRATION PLATE BEFORE STARTING ANY BUSINESS UNDERTAKING IN THE MUNICIPALITY OF MARIBOJOC, BOHOL AND APPROPRIATING THE SUM OF P6,000.00 FOR THE PURPOSE”

WHEREAS, the Municipality of Maribojoc is experiencing a growth both on population and commercial activities. There is need for the Local Government to attune its program of action to generates more revenues in order to support the basic services required by the constituency;
WHEREAS, the action programs to meet the demends of the Socio-Economic growth of the Municipality is the Business Licensing System through the requirement of Business / License Registration Plate for every Business Establishment and / or occupation undertaking before starting a business or undertaking. This permit / licensing registration. It endeavors to flush out business entities without the required business permits / license in fairness to legitimate business concerns who have business permits / license to operate in the Municipality of Maribojoc. This undoubtedly shall generate more revenues for the Municipal Government;
WHEREAS, Republic Act No. 7160, otherwise known as the Local Government Code of 1991, has given Local Government Units greater autonomy especially the power to generate its own sources of income. Pursuant to Section 447 (3) of RA No.7160, Sangguniang Bayan has the power and authority to regulate the operation of any business, occupation or practice of professional which does require government examination within the Municipality and the conditions under which the license for said business or practice of professional may be issued or revoked and the power to impose a tax, fee or charge in order to generate revenues under Section 132 of the same code;
NOW, THEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol in its session duly assembled, that;
SECTION 1- The owner / manager proprietor / president / operator of any business entity and joint venture enterprises are hereby required to obtain and secure a Business Permit / License Pre numbered Registration Plate from the office of the Municipal Treasurer before the start of any business operation or undertaking in the Municipality of Maribojoc and to pay the corresponding reasonable fee or charges in the amount of P25.00 per plate representing the cost and other related expenses therefore;
SECTION 2- The Business Permit / License Registration Plate (BPLRP) may be used for a period of five (5) years to be replaced thereafter but shall be renewed yearly with a printed sticker bearing a current year of issuance and is visibly indicated and attached to the BPLRP (Plate) and the cost of P5.00 which include regulatory expenses shall be charge to the entities / enterprises as enumerated in the preceding section of this ordinance.
SECTION 3- This BPLRP (Plate) shall be permanently and conspicuously displayed within the establishment concern and must be visible to the public view. It is required that this plate must be properly taken cared otherwise if found out that same is missing or destroyed the entities / enterprises as mention in Section 1 of this ordinance shall be liable and has to pay the Municipal Treasurer the amount of P25.00 as replacement cost of the new Plate to be issued.
SECTION 4- The Municipal Mayor through the Treasurer of this Municipality is hereby authorized to promulgate by Executive or Memorandum Order the proper and necessary Implementing Rules and Regulations and the amount of P6,000.00 is hereby appropriated for the cost of the BPLR Plate and regulatory expenses to carry out the purpose of this ordinance.
SECTION 5- Penalty: Any violation of the provisions of this Ordinance by any persons / entities enumerated under Section 1 hereof shall be punished by a fine of not less than One Thousand Pesos (P1,000.00) or imprisonment of not less than one (1) month or both at the discretion of the court.
SECTION 6- Repealing Clause: Any ordinance, rules and regulations, order or portion thereof which is contrary to or inconsistent with this Ordinance is hereby repealed, amended or modified accordingly.
SECTION 7- Effectivity:
This Ordinance shall take effect on January 2, 1994.
