AN ORDINANCE PENALIZING DRUNKARDS FROM LOITERING IN ANY PUBLIC BUILDINGS AND PLACES AND BUSINESS ESTABLISHMENT IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, it is the duty of the state to exercise police power in order to protect its citizens and provide for the safety and good order of the society;

WHEREAS, the exercise of such inherent power of the state is so important notwithstanding the constitutional rights of a person, in order to uphold orderly governance as it is necessary for the proper maintenance of the government and the general welfare of the community;

WHEREAS, it is one of the duties of the Sangguniang Bayan as the legislative body of the Municipality to enact ordinances intended to prevent, suppress and impose penalties for habitual drunkenness in public places.

WHEREAS, premised on the following reasons, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol that;

SECTION 1- It shall be unlawful for any person or group of persons who under the influence of liquor, fermented or not, and get drunk that would lead him/them to cause destruction of properties, inflicting bodily injuries and shouting provocative / challenging words to anybody or in the public during day and night time.

SECTION 2- Any drunk person or group of persons who shall loiter in any public place and business establishment which may cause disturbance and annoyance will be apprehended and brought to the Police Headquarter for interrogation and medical test necessary.

SECTION 3- The chief of police or any of the desk officer in duty may seek the help of the Municipal Health Officer or any private Physician in the Municipality for medical test of the person in the state of drunkenness.

SECTION 4- Any drunk person or group of persons who shall create disturbance in any public or private gatherings and assemblies in the remote barangays shall be subjected to the apprehension of the Barangay Captains as person in authority with the help of the Civilian Volunteers members and maybe charged in the Barangay Court for violation of any Barangay Ordinance related to this ordinance.

SECTION 5- If municipal employees and officials including national employees will be found in the state of intoxication during working hours aside from the penalty imposed in Sec.6 they will be given a stern warning leading to suspension and outright dismissal.

SECTION 6- Owners of any business establishments or recreation centers may seek for the Police Officers or any of the Civilian Volunteer officer for the immediate arrest of any drunk person who may cause trouble within the premises of the said establishment.

SECTION 7- For any violations of this ordinance, the following penalties shall be imposed:

1st Offense P200.00
2nd Offense P300.00
3rd Offense P500.00 plus imprisonment of ten days

SECTION 8- The violator shall remain under the custody of the police officer until such time that the above penalties are strictly complied with.

SECTION 10- The provision of Municipal Ordinance No.33, 58 series of 1961 and 1971 respectively are deemed modified and repealed accordingly.

SECTION 11- This ordinance shall take effect upon approval.
