AN ORDINANCE AMENDING SECTION 5E.01 OF CHAPTER V, REVISED REVENUE CODE OF THE MUNICIPALITY OF MARIBOJOC, BOHOL, CY 1992 CONCERNING CHARGES FOR THE USE OF THE MARIBOJOC WATERWORKS SYSTEM AND PROVIDING RULES AND REGULATIONS GOVERNING THE OPERATION OF THE SYSTEM.

WHEREAS, R.A. 7160, otherwise known as the Local Government Code of 1991, has given the Local Government Units greater autonomy, especially the power to generates its own sources of income;

WHEREAS, there is indeed a need to increase the water rates of the Maribojoc Waterworks System in order to provide an efficient and sufficient water services to its water consumers;

WHEREAS, it is necessary to provide rules and regulations that will govern the operation of the Maribojoc Waterworks System so that the Local water subscribers will be aware of the procedures, guidelines and policies in availing the services of the Municipal Waterworks System and the proper utilization and conservation of potable water from its sources;

NOW, THEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol in session duly assembled;

ARTICLE – I APPLICATION FOR INSTALLATION AND SERVICES

Sec.1- any resident, whether permanent or temporary, who dwells in the town of Maribojoc may apply for water connection by filling up the application form for installation of water service in the office of the Municipal Engineer.

Sec.2- Water subscriber shall be installed with water connection if he/she complies the following requirements:

a.) Installation Fee:

1. Existing old pipelines transferred to New Lines P 75.00
2. New installation, including inspection fee P 100.00

b.) Duly approved application form
c.) Subscribers contract duly signed by the Municipal Mayor
d.) Bill of Materials shall be determined by the Municipal
Engineer and shall be purchased by the water subscriber
e.) Orientation seminar

Sec.3- The Maribojoc Waterwork System shall install a brand new water meter in every connection and shall have the right to examine the water meter every month for the purpose of checking the accuracy of the consumption of water and likewise check whether the water meter has a defect or malfunctioning. If incase Maribojoc Waterwork System can not provide water meter, the water subscriber shall purchase his/her own.

Sec.4- The water meter shall be paid by the water subscriber either in full or in installment basis until it shall be fully paid. Any damage of the water meter whether caused by will full destruction, wear and tear and negligence the subscriber shall pay the whole amount of the repair or replacement of new one. Failure to pay of any repair or replacement of new water meter shall be subjected to temporary disconnection from its water connection.

ARTICLE – II VOLUNTARY DISCONNECTION AND RECONNECTION

Sec.5- If ever water subscriber wishes to disconnect voluntarily his water service from the waterworks system, he/she shall apply formally for water service disconnection by informing the Municipal Engineer and filling up the application form for voluntary disconnection. The contract entered into between the subscriber and the Municipality shall be surrendered whenever the latter decides for voluntary disconnection from the waterworks system.

Sec.6- Grounds for disconnection of water service are as follows:

a.) Non-payment of water bill for two (2) consecutive months.
b.) Willfull destruction of the water meter.
c.) Failure to repair the destroyed water meter and failure to replace non-serviceable water meter within the prescribe period.
d.) Use of mechanical devices that would deregulate the movement of water meter to the extent of depriving the government from revenues.
e.) Non-observance of the provisions of the contract of water connection.
f.) Transfer of residence.

Sec.7- Reconnection of water service shall only be made upon compliance of the following;

a.) Payments of delinquency, if any
b.) Payment of reconnection fee of P30.00
c.) Approval of application for reconnection

Sec.8- Only authorized personnel of the Waterworks System shall be allowed to retap water from the water source to the service connection.

Sec.9- Water subscriber shall be required to sign a second contract incase of reconnection after one year disconnection.

ARTICLE – III WATER RATES AND MODE OF PAYMENTS

Sec.10- Amendments- Sec.5E.01 of Chapter V, Revised Revenue Code of the Municipality of Maribojoc, Bohol, CY 1992, regardless charges for the use of the Maribojoc Waterworks System, to read as follows:

Water Rate

1. A minimum charge of P45.00 for the first 10 cu.m.
2. P2.00 in excess of 10 cu.m.

Sec.11- Notice of payment of water consumption shall be serve without delay by the Water Meter Reader to the water subscriber and payment shall be made at the Office of the Municipal Treasurer.

Sec.12- The Maribojoc Waterwork System shall determine the water consumption and distribution of water bills for the current month to the subscribers shall be done during the first week of the following month. Paying period shall be up to the 17th day of the month after the current month. In case the 17th day falls on a non-working day payment thereof shall be made on the next working day.

Sec.13- Non-payment of water bills for two (2) consecutive months in spite of demand letter, it shall mean immediate disconnection of the service. If the subscriber pays only partial payment of the total initiated by the office of the Municipal Treasurer, stating threat the specific period of liquidation of the remaining balance and a surcharge of 10 shall be imposed after the grace period of ten (10) days has been lapsed.

ARTICLE – IV GENERAL PROVISION AND RATIONALE

Sec.14- It is the duty of the water subscriber whose water meter is found to be malfunctioning of defective to report immediately to the office of the Maribojoc Waterwork System, through its authorized personnel specifically the Municipal Engineer so that repair could be done without delay. The cost of repair of the damaged water meter shall be shouldered by the Municipal Government in cases of destruction caused by any fortuitous event or force majeure. If the subscriber failed the report the defects of the water meter, then drastic action shall be taken against the said consumer.

Sec.15- It shall be the duty and responsibility of the water subscriber to safeguard the water meter attached to his/her connection so as to evade any lose or destruction of the meter. Under this condition, the water meter shall be located as determine by the authorized personnel of the Maribojoc Waterworks System but under no circumstances shall the water meter be placed inside the subscriber’s house.

Sec.16- Failure to repair and replaced the defective water meter within the prescribed period of one (1) week, it shall mean disconnection of the service.

Sec.17- Before any alteration, change or modification of the location of the water meter of the subscriber can be made, a permit must first be secured from the office of the Maribojoc Waterworks System Office through its authorized personnel and only the personnel of the waterworks system duly designated is allowed to undertake such work, with a corresponding service charge of P45.00.

Sec.18- No Tee connection be installed at visible and accessible location to the water meter readers.

Sec.19- The use of jumpers, boaster pump, hose or any magnetic devices or instrument purposely installed to evade the register of the correct amount of water consumption or any other manner which deprive the government of its dues and revenues shall be aground of disconnection without prejudice to the filing of appropriate criminal charges in court.

Sec. 20- Sub-leasing of water services or connection shall be strictly prohibited unless a written approval from the water system is secured.

Sec.21- Leaking or destroyed faucet of the subscriber shall be replaced immediately at the expense of the owner.

Sec.22- Connection from the source of water supplied by the Maribojoc Waterworks System without the prior approval from the system’s Municipal Engineer or authorized personnel is deemed illegal.

Sec.23- Any person or group of persons who fetch water from the Maribojoc Waterworks System by using water truck and other vehicles for private or commercial purposes shall ask permission from the Municipal Government and shall be collected a fee per truckload on the approval existing ordinance.

Sec.24- It shall be the sole duty of the Sangguniang Bayan to enact ordinances issue guidelines and policies relevant to the governance of the Maribojoc Waterworks System.

Sec.25- The Maribojoc Waterworks System shall prepare all necessary forms herein provided and may issue guidelines, rules and regulations to further the effective implementation of this ordinance.

Sec.26- The prime purpose of this ordinance is to update the old water rates of the Maribojoc Waterworks System in order to generate more income for the improvement of the Maribojoc Waterworks System with the vision of giving the water concessionaires the most efficient water supply.

ARTICLE – V FINAL PROVISIONS

Sec.27- Any violation of this ordinance shall be fined of not more than One Thousand Pesos (P1,000.00) or an imprisonment of not more than six (6) months or both at the discretion of the court.

ARTICLE – VI REPEALING CLAUSE

Sec.28- ANY ORDINANCE inconsistent with the provisions of this ordinance are hereby repealed and modified accordingly.

ARTICLE – VII EFFECTIVITY

Sec.29- This ordinance shall take effect upon approval.
