AN ORDINANCE REGULATING THE OPERATIONS OF KARAOKE BARS IN THE MUNICIPALITY OF MARIBOJOC.

STATEMENT OF PURPOSE – In the exercise of its inherent and plenary to regulate economic enterprises, a Municipal Corporation may retrain and set in the form of a policy other regulatory rights on any and all activities that are harmful to the comfort, safety and welfare of society.

RATIONALE: The use of property bears a social function and all economic agents shall contribute to the common good. Individuals and private groups, including corporations, cooperatives and similarly situated organizations, shall have the right to own, establish, and operate economic enterprises, subject to the duty of the Municipal Government to promote distributive justice and to intervene when the common good so demands.

WHEREFORE, based on this premise, be it ordained by the Sangguniang Bayan of the Municipality of Maribojoc, Bohol in its session duly assembled, that:

SECTION 1: Scope & Limitation.- This ordinance shall regulate the operation of Karaoke Bars and other similar establishment in the Municipality of Maribojoc, Bohol. Any provision/s and or section/s of an ordinance/s, statutes and laws not mentioned under this ordinance shall be deemed incorporated herein.

SECTION 2: Definition of Terms.:

2.1 Video Karaoke – an instrument used for showing/singing with the aid of a
television set and other audio/video electronic device.
2.2 Commercial – having financial gain as an object/purpose.

SECTION 3: Regulation.- Any person, corporation or partnership who shall engage in the operation, maintenance and establishment of commercial video karaoke house shall comply the requirement and must abide to be governed by the following terms and conditions:

3.1 Mayor’s Permit / Business Permit
3.2 Video Karaoke House shall be turned-off and closed at ELEVEN O’CLOCK
IN THE EVENING (11:00 PM) TO FIVE O’CLOCK IN THE MORNING (5:00 AM) OF THE FOLLOWING DAY.

SECTION 4: Penal Provisions.-. Any persons, corporations or partnership that violates any provisions of this ordinance shall suffer a penalty based on the following:

First Offense – P 500.00
Second Offense – P 1,000.00
Third Offense – P 2,000.00 and revocation of the permit or
closure of the establishment

SECTION 5: This ordinance shall take effect upon approval.

Let copies of this measure be furnished the Sangguniang Panlalawigan of Bohol, Tagbilaran City and other concerned offices & agencies for information, guidance and appropriate action.
