PROPOSED ORDINANCE REGULATING THE CUTTING OF COCONUT DEREGULATED THE FOREST TREES IN THE LOCALITY OF MARIBOJOC WITHOUT SECURING FIRST THE MAYOR’S PERMIT.

WHEREAS, Art. 100 of the Rules and Regulations Implementing the Local Government Code of 1991 provides one of the specific duties of the Sangguniang Bayan, to enact measure that will protect the environment and impose appropriate penalties for acts which endanger the environment such as illegal logging and smuggling of forest and natural resources products;

WHEREAS, cutting of coconut and deregulated forest trees are rampant in the remote barangays of the locality;

WHEREAS, if cutting of coconut and deregulated forest trees will not be regulated these request our coconut products as well as this will lead to forest denudation and soil erosion;

WHEREAS, the Office of the Environment and Natural Resources is partially devolved in the local government units, this will enable to have a direct control on the use of forest and Natural Resources;

WHEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc that:

Sec. 1. Any person or group persons who wish to cut and slice coconut and deregualated forest trees for any purposes shall secure first the mayor’s permit.

Sec. 2. For every coconut trunk cut and slice into lumber, an amount of two pesos(P2.00) shall be collected from the owner and this will be reflected in the permit.

Sec. 3. For every deregulated forest trees cut and slice into lumber an amount of ten pesos (P10.00) shall be collected from the owner.

Sec. 4. For every coconut and deregulated forest trees cut and sliced into lumber, there shall be an immediate corresponding replacement based on barangay certification thereof and shall be included in the mayor’s permit.

Sec. 5. Coconut trees affected with beatle disease, hit by lighting and those which endanger the lives of the occupants of the houses may be exempted from payment of the mayor’s permit.

Sec. 6. It shall be the duty of the barangay officials to report and monitor as soon as possible to the Office of the Sangguniang Bayan and the local chief executive for any illegal transaction to this matter.

Sec. 7. Any violation of this ordinance shall be fined of not less than one thousand pesos (P1,000.00) or an imprisonment of not more than six months or both of the discretion of the court.

Sec. 8. This ordinance shall take effect upon approval.

LET COPIES of this ordinance be furnished to the Office of the Department of Environment and Natural resources and to all Barangay Captains of the Municipality of Maribojoc for information, guidance and implementation.
