AN ORDINANCE BANNING THE USE OF ILLEGAL FISHING GEARS IN THE MUNICIPAL SEAWATERS OF MARIBOJOC, BOHOL.

Be it ordained by the Sangguniang Bayan of the Municipality Maribojoc, Province of Bohol that:

Sec. 1 – This Ordinance shall be known as the “ PROHIBITED FISHING ORDINANCE” of this Municipality.

Sec. 2 – Definition of Terms:

Municipal Seawaters – for the purpose of this Ordinance the words Municipal Seawaters include not only streams, lakes and tidal waters included within the Municipality of Maribojoc, not being the subject of private ownership and not comprised within National Parks, public forests, timber lands, forests reservism, but also marine waters included between two lines drawn perpendicular to the general coastline from points where the boundary lines of the Municipality touch the sea at low tide and a third line parallel with the general coastline three nautical miles from such coastlines. Where two municipalities are so situated on the opposite shores that there is less than six nautical miles of marine between them, the third line shall be drawn equidistant from the opposite shores of the respective municipalities.

Fishing Gears – in the ordinance means any kind of fishing instruments used to catch fish.

Sec. 3 – The Municipality of Maribojoc defines the following fishing gears as illegal and hereby prohibit its used in the Municipal Seawaters of Maribojoc, Bohol.

a. ) Electric Shiners – a fishing gear using light backs with generator that is
capable of generating eight ( 8 ) units 2000 ( two
thousand ) volts bulb.

b. ) Solar Fishing – usually about five ( 5 ) tons fishing boat that operates
with a solar fishing instrument to determine the quantity
of fish below the seawaters.

c. ) Motor Operated Sagiwsiw – two adjacent ( 15 ) horsepower pumpoboats
that operates with a large fish nets.

d.) Bahan – a destructive fishing using coconut leaves reach down
sea bottom which could possibly district aquatic lives

e.) Pamana using Compressor – a method of fishing which uses “pana”
compressor and intoxicated sprays.

f. ) Liba-Liba – a fish trap similar to sagiwsiw that uses a large fish net
for dragging along sea bottom with weights and destruct
marine lives and fish corals.

g. ) Sodsod or Dosdos – a fish trap of flow like made of bamboo sticks and
nets that destruct the fish corrals and other acquatic lives.

h. ) Poisoning – fishing through the use of poisonous materials and
other intoxicated chemicals.

i. ) Catching Fish Semilla – catching fry or other species for propagation,
decoration and export.

j. ) Electrifying – fishing through the use of electric current.

k. ) Any instruments or materials use for noise and disturbance that will
endanger the aquatic lives are also prohibited of its use in the Municipal
Seawaters of Maribojoc.

l. ) Any fishing gears used illegally to catch fish are prohibited.

Sec. 4 – That all permits or any fishing fees issued in the Municipality of Maribojoc for fishing gears enumerated in the previous section are hereby cancelled and considered invalid.

Sec. 5 – Pursuant to the provisions of the Local Government Code of 1991, the Sangguniang Bayan, as the legislative body of the Municipality of Maribojoc shall protect the environment and impose penalties for acts which endanger the environment such as dynamite fishing and other forms of destruction fishing. Refer to paragraph VI, Section 447 General Primer of the Local Government Code of 1991.

Sec. 6 – That the Municipality cannot grant taxes or issue license permit to any
person, cooperatives, partnership, association or corporation for the purpose of operating the kind of fishing gears as provided for by this ordinance.

Sec. 7 – Any individual or entity found violating any provision of this ordinance shall be punished by a fine of not less One Thousand Pesos (P1,000.00) or an imprisonment of not less than one month or confiscation of fishing equipment or both at the discretion at the court.

Sec. 8 – Any ordinance or regulation or portion hereof inconsistent to the provisions of this ordinance are hereby repealed.

Sec. 9 – That copies of this ordinance be furnished to the chief of Police, Barangay Officials and all concerned in the Municipality of Maribojoc, Bohol for proper guidance and implementation.

Sec. 10 – This ordinance shall take effect upon approval.
