AN ORDINANCE GRANTING FRANCHISE TO NIÑA CABLE TO INSTALL AND OPERATE ITS SYSTEM IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

BE IT ORDAINED by the Sangguniang Bayan of Maribojoc, Bohol, that:
SECTION 1 : DEFINITION OF TERMS:
A. Franchise – a particular privilege or right granted by a sovereign or legislative body to an individual or corporation.
B. Cable TV (CATV) – a System for transmitting television programs by coaxial cable to individual subscribers.
C. Operator – one who operates and own, specifically, if applied to this ordinance, one of this ordinance, one who transacts business for another with the use of communication instruments. (Public Utility)
SECTION 2 : The Operator of Niña Cable TV must have the adequate knowledge regarding the basic norms of its operations in conformity with the mandate of the Local Government Code, as such; the essential element of a franchise is that it would be a privilege, right or power which the individual can not exercise as a right and which its lawful existence must always depend from the LGU of Maribojoc, Bohol.
SECTION 3 : TERMS AND CONDITIONS:
The following terms and conditions shall form part thereof:
a. The franchise shall not be exclusive in character.
b. The grant shall not be a period of longer than fifty (50) years.
c. The franchise shall be subject to amendment, alteration or repeal by the granting LGU concerned when public interest so requires.
SECTION 4 : AREAS OF OPERATION:
The areas of operations of the Niña Cable TV shall be within the entire Municipality of Maribojoc, Bohol, but subject to the provisions of the National Telecommunications Commission (NTC-DOTC).
SECTION 5 : There is hereby created a multi-sectoral special committee to be headed by the Presiding Officer of the SB to promulgate rules and regulations necessary for the proper implementation of this ordinance.
SECTION 6 : EFFECTIVITY:
This ordinance shall take effect upon approval.
