AN ORDINANCE CREATING THE MUNICIPAL BANTAY DAGAT COUNCIL ( HUGPONG BANTAY DAGAT OFMARIBOJOC ) FOR PURPOSES OF FULLY IMPLEMENTING AND ENFORCING ALL EXIST LAWS, RULES AND REGULATIONS RELATIVE TO THE PRESERVATION, CONSERVATION AND PROTECTION OF AQUATIC LIFE AND RESOURCES AND ERADICATE AND PROSECUTE ILLEGAL FISHING PRACTICES, WITHIN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, there is a compelling need to increase the production of fish to bring down its price to a level which will be within the reach of our people and at the same time insure the continuity of our fishing resources in productive condition through wise utilization and project conservation;

WHEREAS, fish is one of the major and cheapest sources of protein in the diet of the Boholano people particulary of Maribojochanons;

WHEREAS, there is an urgent need to fully implement and enforce all existing laws, rules and regulations relative to marine conservation, preservation and protection;

WHEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol, that:

ARTICLE I

Title of Ordinance

Section 1 – Title – This shall be known as Municipal Bantay Dagat sa Maribojoc Council Ordinance.

ARTICLE II

Purpose

Section 2 – Purpose – This ordinance is enacted for the purpose of creating the Municipal Bantay Dagat Council to fully implement and enforce all existing laws, rules and regulations relative to the preservation, conservation and protection of the aquatic life and marine resources and eradicate and prosecute all kinds of illegal fishing activities, and such other fishery laws, rules and regulations or ordinance thereto which may henceforth be enacted, within the Municipality of Maribojoc, Bohol.

ARTICLE III

Creation, Composition and Appointing Power

Section 1 – Creation and Composition – There is hereby created a Municipal Bantay Dagat Maribojoc Council under the office of the Mayor, which shall be composed of a Chairman and Members representing governmental and private sectors to wit:

Members – Representative from the Dept. of Local Govt.
– Rep. from the Dept. of Agriculture/Fisheries
– Rep. from the DECS ( Supervisor )
– Rep. from the Religious Sector
– Rep from the PC/INP ( Sta. Commander )
– Rep. from the Youth
– Rep. from the Business Sector
– The Mun. Information Officer
– The ABC President
– The Fed Pres. Fishermen’s Ass.
– The PTA Fed. Pres.
– The Committee Chairman of Fishery ( SB )
– The Prov’l Marine Conservation Officer
– The Fishery Aids

Vice Chairman – SB Member Lonod

Section 2 – Appointing Owner – The Municipal Mayor shall appoint the members of the Council.

Section 3 – Compensation – The Chairman and the members of the Council shall receive no compensation.

ARTICLE IV

POWER OF RESPONSIBILITIES

Sec. 1 – Powers and Responsibilities – The Council shall have the following powers and responsibilities:

a. ) To fully implement and enforce all existing fishery laws, rules and regulations for the preservation, conservation and protection of the aquatic life and marine resources, and control, eradicate and prosecute illegal fishing activities and such other fishery laws, rules and regulations or ordinances relative thereto which may henceforth be enacted, within the Municipality of Maribojoc, Bohol.

b. ) To coordinate with other government and private agencies dealing with the enforcement of fishery laws, rules and regulations for the protection of the marine resources and prosecution of illegal fishing within the Municipality of Maribojoc.

c. ) To promulgate such guidelines, policies, rules and regulations, for effective implementation of its aims and objectives. Not inconsistent with the existing rules and regulations relative to the Bantay Dagat operation of the pumpboat patrol.

1. The creation of the various committees and defining their composition and functions;

2. The adoption of a reward system in controlling illegal fishing activities and
wanton destruction of the marine resources by offering or giving cash rewards
or other incentives to informants leading to the arrest and conviction of
vindicators of fishery laws;

3. The granting of honorarium to invited lectures or speakers of the meetings and
dialogue sponsored and conducted by the council or its working committees,
and the payments of the expenses for the foods, transportation and
accommodation relative thereto;

4. Composition of the office of the Secretariat and staff, their respective duties
and monthly allowances;

5. The holding of its periodic meetings and those of the working committees, to
assess its programs and operations, and thresh out problems confronting the council and such other matter needing immediate attention.

d. ) To make periodic report on its programs and operations to the Municipal
Mayor for his evaluation and recommendation.

ARTICLE V

Working Committees and their Functions

Sec. 1 – Working Committees – To effectively enforce and carry out the aims and objectives of the Council, their shall be created six ( 6 ) working committees, not limited but subject to creation of additional committees as the need arises, which follows:

a. Committee on Intelligence and Operations
b. Committee on Legal Matters
c. Committee on Finance and Logistics
d. Committee on Organization, Development and Seminars
e. Committee on Liason and Monitoring
f. Committee on Information and Dessimination

Sec. 2 – Functions – The functions of the working committee are as follows:

a. The Committee on Intelligence and Operations shall be responsible for the
patrol and in enforcing fishery laws, rules and regulations and arrest and prosecute vindicators thereof.

b. The Committee on Legal Matters shall be responsible on the local problems referred by the operations and intelligence committee;

c. The Committee on Finance and Logistics shall be responsible in the
handlingof budgetary requirements and financial resources of the council and undertake their training in the proper implementation of the aims and objectives of the Council.

d. The Committee on Organization Development and Seminars shall be
responsible for the formation of more Bantay Dagat Councils in Barangay areas and undertake their training in the proper implementation of the aims and objectives of the Council;

e. The Committee on Information and Dessimination shall be responsible in dessiminating informations to the public regarding the plans and programs and other activities of the council, to develop public support and awareness on the importance of preservation and protecting the marine resources.

ARTICLE VII

Secretariat and Staff

Sec. 1 – The Secretariat and Staff – The Council shall maintain a Secretariat at the Municipal Hall to be headed by a Bantay Dagat Municipal Coordinator, with staff from among the municipal and other government agencies, or such other persons as it may deem necessary and convenient, who shall receive a monthly allowance or honorarium from the council if funds are available. They shall be designated by the Municipal Mayor.

Sec. 2 – Repealing Clause – All other ordinance, rules and regulations in conflict with the provisions of this ordinance are hereby repealed.

Sec. 3 – Effectivity Clause – This ordinance shall take effect immediately upon approval hereof.
