Municipal Ordinance No. 30 Series of 2007

AN ORDINANCE REQUIRING ALL AMBULANT LENDING BUSINESS FIRMS DOING BUSINESS ACTIVITY TO OBTAIN A MAYOR PERMIT IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

PRELIMINARY NOTES

WHEREAS, there are many ambulant lending business firms doing business activities in the barangays of Maribojoc, Bohol without paying taxes in the municipality;

WHEREAS, any business activity being conducted within the jurisdiction of the Municipality of Maribojoc, Bohol must have a Mayor’s Permit prior to the start business;

WHEREAS, in order to monitor the activities of the ambulant lending firms in the particular barangay there is a need to scrutinize the activities of the lending firms on the ground that people in the barangays are hard up in paying their monthly amortization due to high percentage of interests imposed to the borrowers;

WHEREAS, many borrowers who have accounts from the ambulant lending firms are paying either monthly or weekly;

WHEREAS, in order to prevent the proliferation of live/six activities in disguise of a “la cooperative” / foundation / organization, a Mayor’s Permit is needed to start their respective business;

WHEREFORE, be it resolved by the Sangguniang Bayan in their session duly assembled:

SECTION 1: Definition of Terms:

a. Lending – to grant to another for temporary use. Lend assistance.

b. Business – commerce, trade or commercial activity regularly engaging as a means of livelihood or with view to profit.

c. Firm – a business house, partnership association, cooperation.

d. Permit – is a right or permission granted in accordance with law or by a competent authority to engage in some business occupation or to engage in some transactions.

e. Ambulant – moving, walking or without fix establishment.

SECTION 2: Any ambulant lending business firm, foundation, association and individual entity
which are ambulant in nature shall be required to obtain a Mayor’s Permit prior in engaging business within the jurisdiction of Maribojoc, Bohol;

SECTION 3: Requirements to obtain a Mayor’s Permit.

a) a Barangay Clearance from the barangay where the business is to be done.

b) Community Tax Certificate of the Manager or representative of the ambulant lending firm.

c) Police Clearance

d) Any Registration Certificate from SEC, CDA government agency approving their association’s registration to operate legally shall be required from an Association or Foundation and it shall be optional for single proprietorship.

SECTION 4: The applicant shall secure a business application form from the Municipal
Treasurer’s Office to fill up the necessary informations.

SECTION 5: Permit / License Fees .

a) License fee - P300.00
b) Mayor’s Permit fee - P200.00

SECTION 6: The permit / license fee shall be paid at the Municipal Treasurers’ Office before
conducting business activity, within the Municipality of Maribojoc, Bohol.

SECTION 7: Penalty.- Any person / corporation or association violating the provisions of this
ordinance shall be fined in the amount of P2,500.00 or imprisonment of six (6) – days or both at the discretion of the court.

SECTION 8: Effectivity: This ordinance shall take effect upon approval.
