REQUIRING ALL OWNERS AND OPERATORS / PROPRIETORS OF BUSINESS AND COMMERCIAL ESTABLISHMENTS IN THE MUNICIPALITY OF MARIBOJOC, BOHOL TO UNDERGO A HALF-DAY SEMINAR ON SOLID WASTE MANAGEMENT PRIOR TO ISSUANCE OF BUSINESS PERMIT AND LICENSE TO OPERATE.

WHEREAS, the increasing population in the Municipality of Maribojoc, Bohol has enhance the increase in the number of business which require consistent and adequate provision of waste management services by the Local Government;

WHEREAS, to maintain the cleanliness of the town and to ensure an effective and efficient solid waste management, the Local Government would like to instill discipline among the owners and proprietors of business establishments on proper waste or garbage disposal;

WHEREAS, the local Government of Maribojoc is cognizant that, in the course of operation of many business and commercial establishments, volumes of solid waste and garbage are accumulated and should be disposed off in accordance with existing rules and regulations;

WHEREAS, to provide awareness and information to owners and proprietors of business and commercial establishments on the LGU’s program on garbage and waste management, a seminar on solid waste management must be conducted as a requirement to applicant of business licenses and permits;

NOW THEREFORE, be it ordained as it is hereby ordained by the Sangguniang Bayan of Maribojoc, Bohol in session duly assembled, that:

SECTION 1: All regular and transient owner’s/proprietors or its representatives of business and commercial establishments in the Municipality of Maribojoc, Bohol are hereby required to attend a half-day seminar on solid waste management;

SECTION 2: Coverage for purposes of this ordinance, owners and proprietors of business and commercial establishments shall refer to those who own and operate businesses required to secure business permit and license to operate from the Office of the Mayor. Provided, however, that in case of big commercial establishments, industrial factories, manufacturing plants and the likes, the assigned or authorized and or responsible official / representative who handles the waste disposal / garbage of the establishment shall be qualified to attend the seminar.

SECTION 3: The seminar on solid waste management shall be required on the
following, to wit:

1.) New applicants for business permits and license to operate and
2.) Applicants for the renewal of business and license to operate, who have not yet undergone the seminar prior to passage of this ordinance.

SECTION 4: There shall be a Trainor’s or Speaker’s Bureau to be created by the Chief Executive to handle the seminar and the members of the Speaker’s Bureau will be given an honorarium for the seminar being conducted by them.

SECTION 5: The Trainor’s Speaker’s Bureau shall be composed of six (6) persons who will handle different topics of the Solid Waste Management Program of the municipality.

SECTION 6: That local funds shall be appropriated for the honorarium of the trainors and the amount shall be determined by the Sangguniang Bayan in a separate appropriation ordinance.

SECTION 7: That the procedures or methodology on the implementation shall be under the discretion of the Chief Executive who will oversee the implementation.

SECTION 8: A “Certificate of Attendance”, shall serve as proof of participation in the seminar, and as a prerequisite to the issuance of the business permit and license to operate.

SECTION 9: Separability Clause.- If for any reason or reasons, any part or provision of this ordinance shall be held unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect.

SECTION 10: Effectivity.- This ordinance shall take effect thirty (30) days after its publication in the bulletin board in the barangays and information in different meetings and assemblies.
