IMPOSING A FEE ON ALLOWING ILLEGITIMATE CHILDREN TO USE THE SURNAME OF THEIR FATHER PER PROVISION OF ARTICLE 176 OF EXECUTIVE ORFER NO. 209, OTHERWISE KNOWN AS THE “FAMILY CODE OF THEPHILIPPINES”.

PRELIMINARY NOTES

WHEREAS, article 176 of Executive Order No. 209, otherwise known as “Family Code of the Philippines” allows illegitimate children to use the surname of their father after the father admitted its paternity;

WHEREAS, illegitimate children may use the surname of their father if their filiation has been expressly recognized by the father through record of birth appearing in the Civil register or when an admission in a public document or private handwritten instrument is made by the father;

NOW THEREFORE, be it ordained as it is hereby ordained by the Sangguniang Bayan in their session duly assembled:

SECTION 1: There shall be a fee of P500.00 to be imposed for the use of the surname of the father per provision of Article 176 of Executive Order No. 209, otherwise known as the Family Code of the Philippines” on the following to wit:

a.) for births not yet registered but registered before the approval of this ordinance.
b.) For births previously registered under the surname of the mother.

SECTION 2: Retroactive Clause.-

This ordinance shall have a retroactive effect for all births accruing
within and outside the Philippines.

SECTION 3: Separability Clause.-

If any portion or provision of this ordinance is declared void or unconstitutional, the remaining portions or provisions thereof shall not be effected by such declaration.

SECTION 4: Repealing Clause.-

All circulars, memoranda, rules and regulations or parts thereof inconsistent with the provisions of this ordinance are hereby repealed or modified accordingly.

SECTION 5: Effectivity.-

This ordinance shall take effect upon approval.
