AN ORDINANCE REGULATING THE HOLDING OF VIGIL IN THE MUNICIPAL HALL OF THE BEREAVED FAMILY OF A DECEASED BARANGAY CAPTAIN MUNICIPAL OFFICIAL OR EMPLOYEE IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, it is an inherent right of the state to maintain peace and order, protect the life, liberty and property and the promotion of the general welfare which is essential for the enjoyment by all constituents of the locality;

WHEREAS, the Sangguniang Bayan as the legislative body of the municipality is empowered to enact measures that shall ensure the safety and protection of all municipal government properties;

WHEREAS, the exercise of the police power is vested in the legislative body of the government as the body that decides what measures are necessary for the protection of social interest;

WHEREFORE, premised of the following reasons, be it ordained by the Sangguniang Bayan that:

SECTION 1: Any person or representative of a bereaved family who desires to hold a vigil inside the municipal building of a deceased municipal official or employee shall see first the office of the mayor for the consent of the latter;

SECTION 2: It is not always to be understood a prerogative of the bereaved family to have their deceased member be displayed in the municipal hall for public visit, voluntary request maybe sought for by the Municipal Officials and Employees through the Local Chief Executive.

SECTION 3: The following guidelines shall be observed in the holding of a vigil in the municipal hall:
a.) Only a deceased incumbent municipal official and employee or retired employee, DILG, Post Office, Comelec, Butel, PNP and Barangay Captains of the municipality shall be granted the privileges.
b.) In case the bereaved family wishes to hold a vigil in the municipal hall, he shall fill up a reservation form three days before holding of a vigil.
c.) The municipal government shall host only as far as the venue is concerned. However, the local chief executive may request the municipal and employees to join the vigil.
d.) A representative of the bereaved family shall be around in the course of the vigil to entertain visitors, and friends.
e.) Parlor games maybe allowed in the wake of the vigil with the permission of the bereaved family.
f.) During the vigil, complete reverence shall be observed. Excessive serving of intoxicating liquor must be discouraged.
g.) The holding of a vigil shall be one day only.

SECTION 4: The bereaved family shall provide their own paraphernalia for the course of the vigil. Any borrowed properties of the municipality shall be turned over the transfer of the deceased or one day after the interment.

SECTION 5: Failure to observe any of the provisions of this ordinance shall be sent a memorandum letter three days after the interment.

SECTION 6: This ordinance shall take effect upon its approval.
