REGULATING THE SAGIWSIW FISHING GEARS IN THE MUNICIPAL SEAWATERS OF MARIBOJOC, BOHOL AND IMPOSING FEES THEREOF.

Preliminary Notes

WHEREAS, the MFRMC has passed a resolution requesting the Sangguniang Bayan to amend Section 4 of Municipal Ordinance No. 534, series of 1992;

WHEREAS, the said ordinance dies not prohibit the use of “sagiwsiw” fishing gear net aboard non-motorized banca (barato) in our municipal seawaters of Maribjoc;

WHEREAS, permitting fishermen to use sagiwsiw fishing gear with the use of non-motorized banca (baroto) in our municipal seawaters does not violate the Municipal Ordinance No. 546 series of 1992;

WHEREFORE be it resolved by the Sangguniang Bayan in their session assembled;

BE IT ORDAINED by the Sangguniang Bayan of Mari bojoc, Bohol, that:

SECTION 1 – The use of sagiwsiw fishing gear aboard a non-motorized banca (baroto)
using paddle is permitted in the Municipal Seawaters of Maribojoc, Bohol.

SECTION 2 – The use of sagiwsiw fishing gear aboard a non-motorized banca (baroto)
using paddle is permitted in the Municipal Seawaters of Maribojoc, Bohol.

SECTION 3 – Limitations – The use of sagiwsiw fishing gear aboard a paddled
“baroto” has the following limitations.

a. The fishing net shall measure only fifteen (15) meters in length and five
(5) meters in depth.

b. The Sagiwsiw fishermen shall keep in the municipal seawaters of
Maribojoc at 10 to 15 fathom deep.

c. The Sagiwsiw fishermen shall keep distance of 100 meters from the
basing fishermen who are fishing in the municipal seawaters.

SECTION 4 – Inspection of the fishing gear.

The “Bantay Dagat” personnel shall inspect the sagiwsiw fishing gear before a payment is made at the Municipal Treasurer’s Office and a Mayor’s Permit is issued by the Office of the Mayor.

The Bantay Dagat Personnel shall submit an inspection report to be attached to the application papers of the sagiwsiw fishermen.

SECTION 5 – Requirements for Mayor’s Permit.

The Sagiwsiw fishermen shall present to the Licensing Office the following:

a. Barangay Clearance
b. Police Clearance
c. Sanitary Permit
d. Inspection Report of Bantay Personnel

SECTION 6 – Fees to be collected. There shall be a fee of P250.00 per annum to be
paid at the Municipal Treasurer’s Office before fishing in the seawaters.

SECTION 7 – Penalty. Any person or group of persons who violate the provisions of this
ordinance shall be fined in the amount of P2,500.00 or imprisonment of 5 days or both at the discretion of the court.

SECTION 8 – Repealing Clause.

All provisions of any existing ordinances, orders or regulations inconsistent herewith are hereby amended, modified or repealed accordingly.

SECTION 9 – Effectivity. This ordinance shall take effect upon approval.
