AN ORDINANCE PROVIDING GUIDELINES IN THE SALE OF COMPOST “SOIL ENHANCER / CONDITIONER OR FERTILIZER” IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, the LGU-Maribojoc, in its effort to promote public health and safety has establish the Integrated Solid Waste Management System in the Municipality of Maribojoc;

WHEREAS, in the implementation of the Integrated Solid Waste Management System biodegradable waste materials were made into compost through the process known as “composting”;

WHEREAS, there are persons or group of persons who would want to buy compost for their own use from the Municipality of Maribojoc;

NOW, THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by the Sangguniang Bayan of the Municipality of Maribojoc, in session duly assembled, that:

SECTION 1: Definition of Terms:

a. Biodegradable – waste materials that can be reduced into finer particles or refuse that are basically decomposable.

b. Compost – decayed organic materials for use as soil enhancer / conditioner or fertilizer.

c. Composting – the process of making biodegradable waste materials into compost by mixing then soil, water, biological additives / activators (optional) and air.

d. Buyer – any person or group of persons that buy something of value at a favorable price.

SECTION 2: Authorization of the Local Chief Executive;

The Local Chief Executive is hereby authorize sell the compost based on the selling price per sack as determined by the Municipal Agricultural Officer.

Further, the Local Chief Executive is hereby authorize to give discount to buyer of compost, however, the selling price per sack of compost net of the discount shall not less than the average cost of producing one (1) sack of compost.

SECTION 3: Determination of the Selling Price.

The Municipal Agricultural Officers shall determine the selling price of compost per sack based on the average cost of producing one (1) sack of compost plus 15 percent mark-up.

SECTION 4: Procedures.

1. Any person or group of persons who would want to buy compost should first see the Municipal Agricultural Officer for the availability of compost before arranging payment to the Municipal Treasurer’s Office.

2. After payment has been made the buyer is given a note by the Municipal Treasurer requesting the Municipal Agricultural Officer to release the number of sacks of compost as indicated in the Official Receipt.

3. The Municipal Agricultural Officer releases the compost after comparing the note with the buyer’s Official Receipt and then file the note in a chronological order for record and verification purposes.

SECTION 5: Penalty.

Any person or group of person who violate the provisions of this ordinance shall be fined in the amount of P2,000.00 or imprisonment of five (5) days or both at the discretion of the court.

In addition, municipal officials and employees who violate any of the provisions of this ordinance shall be charged administratively before the Sangguniang Bayan.

SECTION 6: Repealing Clause.

All provisions of any existing ordinances, orders or regulations inconsistent herewith are hereby amended, modified, or repealed accordingly.

SECTION 7: Effectivity:

This ordinance shall take effect upon approval.
