AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 37 SERIES OF 1994, DECLARING CURFEW IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, one of the primary program of the Local Government Unit of Maribojoc, Bohol is the maintenance of Peace and Order in the locality.

WHEREAS, curfew ordinance is a factor that contribute much in deteriorating and even denying the commission of crimes in the locality;

WHEREAS, there is a need to amend Municipal Ordinance No. 37, series of 1994, declaring curfew hour in the municipality of Maribojoc in order to provide provisions that actually fit the present situation in the locality.

WHEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol, that:

SECTION 1: Definition of Terms as used in this particular ordinances.

1. Minors – all individual below 18 years of age.
2. Adult- all individual 18 years old and above.
3. Parent – the fathers and or mother of minors.
4. Guardians – persons other than the parent.

SECTION 2: Rules and Regulations

a. No minors shall roam or loaf in the street or public places during curfew hour from 10 PM to 4 A.M.

b. No adult are allowed to roam or loaf in any public places during curfew hour from 12 MN to 4 A.M.

c. All stores or any business establishment engaged in selling tuba, liquor or any intoxicating drinks are prohibited from selling it during curfew hours for adults.

d. This section shall be without effect on the eve of feastdays and day after the town or barangay fiesta and shall be applicable only to the particular place celebrating its fiesta.

e. It is likewise ineffective during holy week from holy Thursday to Easter Sunday, December 24, 25, 30 and 31, and January 1 of every year or when so declared by the Municipal Mayor through Executive Order suspending curfew hours when social, cultural and other activities that required community participation.

f. Parents or Guardian are held responsible of their minors against violation on this ordinance.

g. It is also ineffective to those who are at the immediate vicinity within 30 meters radius from the house of the bereaved family during the wake.

h. Apprehended minors shall be taken into police custody for proper disposition and documentation and for subsequent turn over to DSWD for counseling with their parent or guardians.
SECTION 3: Exemption.-

a. When arrival from a trip or disembarking from any means of transportation, even if minors are not accompanied by a responsible persons.
b. When minors are in the company of their parent or guardians or elder person during curfew for minors;
c. When minors is out on a legitimate errand or attending school activities and program upon confirmation by a teacher, parent or guardian;
d. When a person is out to attend his livelihood activities;
e. When a person is out for emergency reasons that involves the safety of life and property of the people;
f. Those relatives and immediate members of the bereave family who are coming to and from the wake;
g. All Municipal & Barangay Officials to include Barangay Tanods, CVO’s and senior citizen of the Municipality of Maribojoc are exempted in this ordinance.

SECTION 4: Penalty.-

a. Any person who violated any provision of this ordinance shall be penalized as follows, to wit:

1. P200.00 – 1st offense
2. P300.00 – 2nd offense
3. P500.00 – for subsequent offense

b. Parent or guardians who failed to enforce their duties in keeping their minors from violating this ordinances shall be fined of Two Hundred P200.00 pesos other than the fine imposed to the minors violation.

SECTION 5: Repealing Clause.-

All local ordinances, Executive Order, Rules and Regulation or part thereof which are found inconsistent with any provisions of this ordinance are hereby repealed or modified accordingly.

SECTION 6: Effectivity: Upon approval

Let copies of this ordinance be furnished to Chief of Police, Maribojoc Police Station, all Barangay Captain and all Chief Barangay Tanod for their appropriate implementation.
