MUNICIPAL ORDINANCE NO. 552 Series of 1992

AN ORDINANCE REGULATING THE FUND RAISING ACTIVITY THROUGH ENVELOPES AND OTHER SOLICITATIONS IN A FORM OF A CONTEST IN THE LOCALITY OF MARIBOJOC, BOHOL WITHOUT FILING APPLICATION FROM THE OFFICE OF SOCIAL WELFARE AND THE ISSUANCE OF THE MAYOR’S PERMIT.

WHEREAS, there is an existing National Law Act. No. 4075 which is governs all forms of solicitations and contribution from the public for charitable, religious or public purposes;

WHEREAS, it is the duty of the legislative body of a local government unit to enact measures that will protect the public from any fraudulent means of collecting and extracting money in disguise of charitable, religious or civic purposes;

WHEREAS, the fund raising activity through envelopes is commercialized by the organizers through profit sharing motive and likewise commonly abused by the holders by printing additional envelopes with the motive winning and collecting large sum of money.

WHEREAS, it has been practiced by organizers of a fund raising activity through envelopes not to file a formal application for solicitation from the Office of the Department of Social Welfare and Development and envelopes are circulated and distributed around the public;

WHEREAS, the Department of Social Welfare and Development has already been devolved in the local governments pursuant to the provision of the Local Government Code of 1991;

WHEREFORE, be it resolved by the Sangguniang Bayan of Maribojoc, that;

Sec. 1 – It is unlawful for any person or group of persons to raise funds through envelopes and other solicitation inform of a contest without filing a formal application from the office of the Department of Social Welfare and Development and issuance of the Mayor’s permit.

Sec. 2 – Any person or group of persons who wish to solicit funds through envelopes and other solicitation in form of a contest must file first an application stating the name of the organization and the purposes of the solicitation and the target amount for the project in the office of the Social Welfare and Development of Maribojoc.

Sec. 3 – Mayor’s permit shall be issued only upon presentation of the approved application form of solicitation permit;

Sec. 4 – Envelopes aimed to raise funds within the locality of Maribojoc shall be marked registered before they distributed except those issued by the Local Parish Council during special session.

Sec. 5 – Solicitation envelopes distributed without the benefit of registration in the Office of the Department of Social Welfare and Development, the DSWD Chief may issued a stoppage order to the organizer, subjecting the envelopes to confiscation.

Sec. 6 – Any violation of this ordinance shall be fined of not less than One Thousand Pesos ( P1,000.00 ) and imprisonment of not less than One (1) month or both at the discretion of the Court.

Sec. 7 – That copies of this ordinance be furnished to all Barangay Captains in the locality, Office of the Social Welfare and Development and the Sangguniang Panlalawigan.

Sec. 8 – This ordinance shall take effect upon its approval.

AN ORDINANCE REVERTING THE AMOUNT OF P10,000.00 OUT OF THE SURPLUS OF THE ALLOCATION FOR STEEL GATES OF THE 20% IRA FUND, CY 1992 FOR THE IMPROVEMENT-REPAINTING OF CONCRETE FENCE, BENCHES AND RIZAL MONUMENT AT THE TOWN PLAZA OF MARIBOJOC, BOHOL.

Be it ordained by the Sangguniang Bayan of Maribojoc, Bohol, that;

Sec. 1 – That the amount of Ten Thousand Pesos ( P10,000.00 ) out of the allocation of steel gates of the 20% IRA Fund, CY 1992 is hereby reverted and the same be appropriated for the improvement-repainting of concrete fence, benches of Rizal monument at the town plaza of Maribojoc, Bohol.

Sec. 6 – If the foregoing tax shall be collected by the Barangay Units, the Barangay Treasurer thru the Barangay Captains are hereby authorized to collect and receive the corresponding tax and retained 25% thereof representing share for the Barangay Fund.

Sec. 7 – Penalties : Any owner of the foregoing raft, banca or vessel found guilty of violating any acts or omission shall be punished by a fine of not less than One Hundred Pesos (P1,000.00) or imprisonment of not less than one month but not exceeding six (6) months or both at the discretion of the court.

In case the violation is committed by a juridical person or corporation or partnership, the President, Manager, Director, partners or any other officials responsible who shall have instructed or induced the commission of the offense shall be criminally liable as principal thereof.

Sec. 8 – This ordinance repeals all other ordinances inconsistent with this ordinance are hereby amended accordingly.

Sec. 9 – Effectivity : This ordinance shall take effect upon approval.

AN ORDINANCE IMPOSING LANDING OR ANCHORAGE FEE AT THE MARIBOJOC ROCK CAUSEWAY OR WHARF AND FISH LANDING AND DUCKING AREA ALONG THE MARIBOJOC SHORELINES AND RIVER BANKS.

WHEREAS, Republic Act No. 7160, otherwise known as the Local Government Code of 1991, has given Local Government Units greater autonomy most especially the power to produce more income by way of exploring its own sources;

WHEREAS, Section 155 of the said Local Government Code of 1991 empowering or authorizes the Sangguniang Bayan concerned to fix the rate for the imposition of tool fees of charges for the use among other wharf or pier;

THEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol during the session duly assembled;

Sec. 1 – This ordinance shall be known and referred to as Municipal Tax Ordinance of Maribojoc, Bohol.

Sec. 2 – Definition of Terms: The following terms used in this ordinance shall have the following meaning:

a ) Municipal – means the Municipality of Maribojoc

b ) Sangguniang Bayan – means the Sangguniang Bayan of
Maribojoc, Bohol.

c ) Wharf/Causeway – means pier or erection on the shore of a harbor
for discharging or taking in cargoes or
passengers including makeshift wharf along the
seashore or river banks.

d.) Municipal Treasurer – means Municipal Treasurer of Maribojoc,
Bohol.

AN ORDINANCE PROHIBITING THE HOLDING OF ANY DEMONSTRATION, ASSEMBLY AND PROCESSION WITHOUT SECURING FIRST THE MAYOR’S PERMIT.

Be it ordained by the Sangguniang Bayan that:

Sec. 1 – It shall be the duty of the Local Government Units to maintain peace and order, to provide measures to prevent and suppress any form of lawlessness, disorders, riot and violence.

Sec. 2 – Definition of Terms:

a ) Demonstration – means a public exhibition of sympathy with some
political or social motives.

b ) Assembly – means a collection of persons brought together in
one place.

c ) Procession – means a train of persons in formal march.

Sec. 3 – It shall be unlawful for a group of persons to hold any of the above gathering of people which tend to discrupt public orders and safety without first securing the Mayor’s Permit.

Sec. 4 – Any person or group of person who wish to hold a public gathering in any public places should ask the Mayor’s permit three days before its holding to avoid untoward result, conflict on the use of public places and prejudices on the public.

Sec. 5 – Religious procession and assemblies shall be exempted from payment of Mayor’s permit but the office of the Mayor should be informed for the orderly use of public parks and streets.

Sec. 6 – Any violation of this ordinance shall be fined of not less than One Hundred Pesos or an imprisonment of not less than One month or both at the discretion of the court.

Sec. 7 – That copies of this ordinance be furnished to the Station Commander, All Barangay Captains of the Municipality of Maribojoc, Bohol, Parish Priest, Parish Pastiral Council Presidents of Maribojoc, Bohol.

Sec. 8 – This ordinance shall take effect upon approval.

Sec. 1 – This Ordinance shall be known as the “ PROHIBITED FISHING ORDINANCE” of this Municipality.

Sec. 2 – Definition of Terms:

Municipal Seawaters – for the purpose of this Ordinance the words Municipal Seawaters include not only streams, lakes and tidal waters included within the Municipality of Maribojoc, not being the subject of private ownership and not comprised within National Parks, public forests, timber lands, forests reservism, but also marine waters included between two lines drawn perpendicular to the general coastline from points where the boundary lines of the Municipality touch the sea at low tide and a third line parallel with the general coastline three nautical miles from such coastlines. Where two municipalities are so situated on the opposite shores that there is less than six nautical miles of marine between them, the third line shall be drawn equidistant from the opposite shores of the respective municipalities.

Fishing Gears – in the ordinance means any kind of fishing instruments used to catch fish.

Sec. 3 – The Municipality of Maribojoc defines the following fishing gears as illegal and hereby prohibit its used in the Municipal Seawaters of Maribojoc, Bohol.

a. ) Electric Shiners – a fishing gear using light backs with generator that is
capable of generating eight ( 8 ) units 2000 ( two
thousand ) volts bulb.

b. ) Solar Fishing – usually about five ( 5 ) tons fishing boat that operates
with a solar fishing instrument to determine the quantity
of fish below the seawaters.

c. ) Motor Operated Sagiwsiw – two adjacent ( 15 ) horsepower pumpoboats
that operates with a large fish nets.

d.) Bahan – a destructive fishing using coconut leaves reach down
sea bottom which could possibly district aquatic lives

e.) Pamana using Compressor – a method of fishing which uses “pana”
compressor and intoxicated sprays.

f. ) Liba-Liba – a fish trap similar to sagiwsiw that uses a large fish net
for dragging along sea bottom with weights and destruct
marine lives and fish corals.

g. ) Sodsod or Dosdos – a fish trap of flow like made of bamboo sticks and
nets that destruct the fish corrals and other acquatic lives.

h. ) Poisoning – fishing through the use of poisonous materials and
other intoxicated chemicals.

i. ) Catching Fish Semilla – catching fry or other species for propagation,
decoration and export.

j. ) Electrifying – fishing through the use of electric current.

k. ) Any instruments or materials use for noise and disturbance that will
endanger the aquatic lives are also prohibited of its use in the Municipal
Seawaters of Maribojoc.

l. ) Any fishing gears used illegally to catch fish are prohibited.

Sec. 4 – That all permits or any fishing fees issued in the Municipality of Maribojoc for fishing gears enumerated in the previous section are hereby cancelled and considered invalid.

Sec. 5 – Pursuant to the provisions of the Local Government Code of 1991, the Sangguniang Bayan, as the legislative body of the Municipality of Maribojoc shall protect the environment and impose penalties for acts which endanger the environment such as dynamite fishing and other forms of destruction fishing. Refer to paragraph VI, Section 447 General Primer of the Local Government Code of 1991.

Sec. 6 – That the Municipality cannot grant taxes or issue license permit to any
person, cooperatives, partnership, association or corporation for the purpose of operating the kind of fishing gears as provided for by this ordinance.

Sec. 7 – Any individual or entity found violating any provision of this ordinance shall be punished by a fine of not less One Thousand Pesos (P1,000.00) or an imprisonment of not less than one month or confiscation of fishing equipment or both at the discretion at the court.

Sec. 8 – Any ordinance or regulation or portion hereof inconsistent to the provisions of this ordinance are hereby repealed.

Sec. 9 – That copies of this ordinance be furnished to the chief of Police, Barangay Officials and all concerned in the Municipality of Maribojoc, Bohol for proper guidance and implementation.

Sec. 10 – This ordinance shall take effect upon approval.

AN ORDINANCE APPROVING THE SUPPLEMENTAL BUDGET OF BARANGAY ANISLAG, MARIBOJOC, BOHOL FOR C. Y. 1992.

Be it ordained by the Sangguniang Bayan of Maribojoc, Bohol that:

Sec. 1 – That the Barangay Council of Anislag, Maribojoc, Bohol has submitted the Barangay Supplemental Budget covering the period from October 1, 1992 to December 31, 1992 of Anislag, Maribojoc, Bohol review and approval.

Sec. 2 – The Sangguniang Bayan has deliberated the Barangay Appropriation Ordinance No. 2, series of 1992 of Barangay, Anislag, Maribojoc, Bohol.

Sec. 3 – The foregoing Supplemental Budget was reviewed by the Committee on Budget Review with the assistance of the Municipal Budget Officer as the technical review consultant of the Committee.

Sec. 4 – It was found out by the Committee on Budget Review after careful verification and has the following comments and observation on the Supplemental Budget of Anislag, Maribojoc, Bohol for the calendar year 1992:

Sec. 6 – This ordinance shall take effect upon approval.
